Spanish prosecution agency, victim appeal for court to increase Dani Alves’ rape sentence

Spanish state prosecution agency and the victim, who were defendants in Dani Alves’ rape case, are appealing to increase player’s sentence.

The former Brazilian footballer, Alves, is currently facing the appeal from both parties after being convicted of rape and beginning a four-and-a-half-year sentence.

The judge had considered Alves providing €150k in damages to the victim as a mitigating circumstance, leading to the reduced sentence.

However, both the state and the victim have now argued that this amount was not in line with Alves’ means and should not have been considered as such.

Meanwhile, the minimum sentence for Alves’ crime is four years, while the maximum is twelve.

While the victim’s lawyer has not yet formalized their appeal, the state prosecution will argue against the mitigating circumstance, as Alves has not accepted his sentence or shown regret, reports Football Espana.

The Spanish media outlet stated that Alves’ defense is seeking bail until the appeals process is settled and is also appealing to further reduce the sentence.

If the court considers that the victim has been adequately compensated, Alves’ sentence could be reduced to just two years, with over a year already served.

It has also been revealed that even if the current sentence is upheld, Alves could be eligible for day release as early as July this year.

He could further potentially be released after serving three-quarters of his sentence for good behaviour.
